Key Guidelines of the New Law

  1. Definition of Rentals:
    • Rentals shorter than 11 days are classified as tourist rentals.
    • Rentals of 11 days or longer are classified as seasonal rentals and fall outside the purview of this law.
  2. Tourism Licenses:
    • New tourism licenses are valid for 5 years.
    • Renewals should be submitted one month before expiration and will involve municipal re-evaluation.
  3. Homeowners Association Approval:
    • New applications for tourist rentals (from August 2, 2024) require a statement from the Homeowners Association confirming that tourist rentals are permitted.
  4. Whole Property Rental Only:
    • Renting out by room is strictly prohibited; properties must be rented out as a whole.
  5. Cadastral Reference Requirement:
    • All official documents and contracts must include the property’s cadastral reference.
  6. New Application on Changes:
    • A new application for a tourist rental license must be submitted if there are significant changes such as renovation, new construction, sale, donation, or inheritance.
  7. No Combination Rentals:
    • Properties designated for tourist rentals cannot also be rented out for medium or long-term rentals.
  8. Commencement Deadline:
    • Tourists must start renting the property within 2 months of obtaining the tourist rental license, or the license will expire.

Legal Requirements for Property

To be compliant, tourist rental properties must meet certain standards:

  • Evacuation Plan: Displayed inside the front door.
  • Elevator Access: Required for buildings with 4 or more floors.
  • Power Outlets: Present in all rooms.
  • Hot Water Supply: Must be available.
  • Emergency Information: List of important numbers displayed prominently.
  • Heating and Cooling: Must be provided in common areas (living/dining room or kitchen).
  • Internet Connection: Essential unless in an area without coverage.
  • First Aid Kit: Should be available on the premises.
  • Medical Center Information: Clearly detailed.
  • Key Management: Must not include locker services on public roads.
  • Cleaning and Linen Services: Regular upkeep required.

Minimum Inventory Requirements

Each property must be equipped with:

  • Furniture (including essential indoor and outdoor pieces).
  • Cutlery and Kitchen Utensils: A complete set for cooking and serving.
  • Linen: Fresh linens for all beds.
  • Closets: Each bedroom must have adequate storage.
  • Kitchen Appliances: Including a refrigerator, iron, microwave/oven, extractor, and cooktops (minimum 2 for up to four guests, 3 for five or more).

Fines for Non-Compliance

Failure to adhere to these regulations could result in substantial fines ranging from €10,000 to €600,000, depending on the severity of the violation. Common offenses include:

  • Incorrectly stating property registration details.
  • Failing to report property transfers.
  • Illegally offering room rentals.

Transitional Arrangements for Existing Licenses

The law outlines specific conditions for existing tourist rental licenses:

  • Houses Licensed Before July 1, 2018: Maintain their license.
  • Houses Licensed Between July 7, 2018, and Law Introduction: Keep their license but must comply with new requirements within five years.
  • Houses Licensed After the Introduction of New Law: Must adhere to new regulations and renew licenses every five years.

While the new law primarily pertains to tourist rentals, it opens doors for medium-term rentals (11 days to 11 months) and long-term rentals (over 11 months), with no specific licenses required for these categories.
